Get Double Your Rental Deposit Back

If a landlord in Alabama does not return your rental deposit within the required timeframe, the tenant is entitled to specific legal remedies. According to Alabama law, the landlord must return the security deposit or provide an itemized list of deductions within 60 days after the termination of the tenancy and delivery of possession. If the landlord fails to do so, the tenant is entitled to receive double the amount of the original deposit, Ala. Code 35-9A-201.


To avoid the landlord’s most likely defense you MUST provide the landlord with a forwarding address.


Additionally, the tenant may recover actual damages and reasonable attorney fees and obtain injunctive relief for the landlord's noncompliance with the rental agreement or relevant statutes. This remedy is in addition to any other rights the tenant may have under the rental agreement or Ala. Code 35-9A-401.
