Landlords Beware! Fatal Eviction Procedure Flaws.

To serve an unlawful detainer complaint, commonly called an eviction action or eviction lawsuit, a landlord must follow specific procedures as outlined in the Alabama Code. The service of process must be made in accordance with the Alabama Rules of Civil Procedure.


If personal service by a sheriff, constable, or process server is unsuccessful, the notice can be delivered to any person who is sui juris residing on the premises. If no such person is found after reasonable effort, the notice can be posted on the door of the premises.


Additionally, on the same day of posting or by the close of the next business day, a copy of the notice must be mailed by first class to the defendant at the mailing address of the premises or the last known address if there is no mailing address for the premises. Ala. Code 35-9A-461.
